Data controller
Who processes your data
The controller of the personal data collected through this website and in the course of the firm’s professional activity is Manuel Álvaro Gutiérrez Alfageme, practising under the name Gutiérrez & Alfageme, Abogados-Solicitors, with address at Galerías Paniagua, Avenida de Paniagua, office 25, Urbanización Sotogrande, 11310 San Roque (Cádiz), tax identification number 32053950T, email info@aga-abogados.com and telephone +34 956 76 99 03.
The firm’s lawyers are bound by the professional secrecy established in the Organic Law of the Judiciary and in the General Statute of the Spanish Legal Profession, which extends to all information received from clients and from those who consult them, regardless of the protection afforded by data protection legislation.
You may address any question about this policy and the exercise of your rights to the email or postal address given above, identifying yourself appropriately.
Data we process and where it comes from
We process the identification and contact details you provide through the contact form, by email, by telephone or on WhatsApp: full name, email address, telephone number, area of enquiry and the content of your message. If you become a client of the firm, we also process the data needed to provide the legal service you have instructed us on, which may include financial, asset and family data and, where applicable, special categories of data when they are essential to defend your interests.
The data come from you, from the documentation you provide and, in the course of the matter, from public registries, authorities, courts and third parties involved in it. Third-party data you provide to us, such as those of the other party or of other heirs, are processed only to the extent necessary for the professional instruction.
Purposes and legal basis
To deal with enquiries received through the website and the other contact channels and, where appropriate, to arrange an appointment. The legal basis is the consent you give when you send the form or contact the firm, which you may withdraw at any time without retroactive effect.
To provide the legal services contracted, including representation before notaries, registries, authorities and courts. The legal basis is the performance of the contract for services and compliance with the firm’s legal obligations, including those arising from anti-money laundering legislation, which requires clients to be identified in certain property and corporate transactions.
To manage the firm’s invoicing and accounts and meet its tax obligations, on the basis of compliance with legal obligations. We do not send marketing communications or build profiles from your data.
Retention periods
Data from enquiries that do not lead to a professional instruction are kept for one year from the last communication and then deleted. Client data are kept for as long as the professional relationship lasts and, once it has ended, for the limitation periods of the liabilities arising from the instruction and of the tax obligations, and for ten years where anti-money laundering legislation so requires. Once those periods have elapsed, the data are deleted or anonymised.

Recipients and international transfers
Your data are disclosed to third parties only when necessary for the professional instruction or required by law: notaries, Land and Companies Registries, the Spanish Cadastre, the Spanish Tax Agency and other public authorities, courts, court representatives (procuradores), experts, sworn translators and other professionals involved in the matter with your knowledge, as well as banks and insurers when the instruction requires it.
The providers that supply services to the firm, such as website hosting, email and management tools, act as data processors under contracts that guarantee the confidentiality and security of the data. If you contact the firm via WhatsApp, the provider of that service may process data outside the European Union in accordance with its own terms and safeguards; you may use the telephone, email or the contact form instead.
Your rights
You may at any time exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability, and withdraw the consent you have given, by writing to info@aga-abogados.com or to the firm’s postal address, enclosing a copy of your identity document or other means of proving your identity. We will reply within one month of receiving your request.
If you consider that the processing of your data does not comply with the legislation, you may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos), Calle Jorge Juan 6, 28001 Madrid, through its website www.aepd.es. We would be grateful if you would allow us to deal with your request before doing so.
Security, minors and updates
The firm applies appropriate technical and organisational measures to guarantee the confidentiality, integrity and availability of the data, including access control to files, encryption of the website’s communications and regular backups. The website is not aimed at children under fourteen; if we became aware that we had received data from a minor without the authorisation of their legal representatives, we would delete it.
This policy may be updated to reflect changes in legislation or in the firm’s activity. The version in force is always the one published on this website. Last updated: September 2026.
