AFO status (asimilado a fuera de ordenación): what it is and what it allows

In short. Homes built without a licence that can no longer be subject to a demolition order can obtain a decision from the Town Hall, known as AFO status (asimilado a fuera de ordenación), that allows them to be lived in, maintained and registered, although not extended.

How the declaration is applied for

The declaration is applied for at the Town Hall with a technical certificate confirming the date on which the works were completed, their safety and habitability and the availability of basic services. With it, utility supplies can be contracted and the property can be recorded at the Land Registry (Registro de la Propiedad).

What it allows and what it does not

It is not the same as legalisation: the home is left in a consolidated but limited situation. Before buying a home in this situation, it is worth knowing which works it will allow in the future and how this affects its value and its financing.
