New builds and resale homes

For new builds, the developer must arrange occupancy once the works have been completed in accordance with the licence. For resale homes, it is advisable to check that the corresponding document exists and that what has been built matches what was authorised.

Homes predating current rules or extended later

Where the home predates current regulations or has later extensions, the situation can be resolved through certificates of age, legalisation or a declaration of AFO status (asimilado a fuera de ordenación), each with different effects that are worth knowing before you buy.
